Fancyful will have no obligation to provide services for Client, until Client agrees to the following terms and conditions and pays the initial deposit. All requirements must be met at least 24 hrs prior to party date and time, or Fancyful reserves the right to refuse service.
Client understands that due to other party scheduling demands, Fancyful’s characters will leave promptly at the agreed-upon party or event end time. Client understands that if the character(s) are held past the agreed-upon ending time, the client will be charged for the amount of party time each character is held for.
Client shall make a non-refundable deposit of 50% of the total sum of Client’s amount owed within 48-hrs from receiving his/her invoice. If the deposit is not made within this specified time-frame, Fancyful reserves the right to surrender the Client’s requested party date and time to other clients. Client will then submit the remaining 50% of the balance owed by the Friday at 4:00 PM before the date of the party/event booking. If Client is contacting Fancyful with a request for a date within one week or less of Client's requested date, the full amount will be due at time of payment. Failure to submit payment by the agreed-upon deadline between Fancyful and Client may result in the cancellation of the booking, subject to Fancyful's discretion and ability to accept the booking at that time. Fancyful is not obligated to render any of its services until full payment has been received.
Client agrees that for the safety of our personnel, if the party location does not match the agreed-upon location submitted by Client, and confirmed by Fancyful, Fancyful will not be held responsible for completing the party, and a refund may be denied as per the discretion of Fancyful Management.
Client understands that Fancyful’s performances and activities are not inherently dangerous, and that Fancyful is not liable for any accidents or injuries that may occur during Client’s event.
Client understands that in the case of any behavior toward Fancyful personnel which places them in fear of personal harm or other mistreatment, the right is reserved to stop their performance immediately, regardless of the end time specified in this contract. Gentle hugging or other appropriate light touch is acceptable where permitted by the individual performer, but any inappropriate or disrespectful behavior, verbal or physical, will not be tolerated. If any performer is forced to end the performance for this reason, no refund will be given.
At no time will Client allow any minor (children) to be alone with Fancyful’s performers. Client understands that Fancyful personnel are performers, not babysitters. Client is responsible for properly supervising the children at Client’s event. This is not negotiable, and is for the protection of the child and the performer.
Client understands that if they plan to host their party outside, they must inform Fancyful management and provide a backup indoor location in case of rain, a heat index exceeding 90 degrees, or other instances of inclement weather. If no backup indoor location is provided for these circumstances, client understands that Fancyful's characters will not be able to attend the party.
Under no circumstances will the Client share Fancyful's performer(s)' personal contact information with any other persons, including the performer's personal phone number or email address. The Client understands that this information is confidential and is only given by the performer in order to ensure that contact has been established between the Client and the performer prior to the party.
In the event of a delay caused by Fancyful personnel, the performer(s) will make up the time in exact measure to the delay from the designated starting time. In the event of a delay caused or requested by Client, the performer(s) will nevertheless leave promptly at the end time specified and agreed to by Client and Fancyful in this contract.
Client will, at the request of Fancyful personnel, provide an adult escort to and from the performer’s vehicle, to ensure the safety of Fancyful personnel and properties.
Client will book his or her party at a venue suitable for Fancyful’s activities, i.e. if the Client desires to book his or her party at a publicly used party venue, Client will ensure a party room has been reserved for Fancyful’s performers to complete their activities listed in the Client’s chosen party package with the Client’s party guests.
In the event that more children are added to my party than initially stated, I will notify management to update my party time accordingly
For outdoor parties, Client agrees to and understands Fancyful's outdoor policy: Client must note the weather report a week before his or her planned event. If the heat index is predicted to exceed 95 degrees, temperature is expected to fall below 60 degrees (with wind chill), or if there is a high chance of rain, the Client will provide an indoor space for Fancyful's portion of the party. Client will have a back-up indoor location in preparation for these circumstances. The Client will also provide a shaded area, free from standing water, mud, or other elements that may cause damage to the costumes. Client must provide a clean chair for the performer to sit in, as well as an area suitable for the performer's activities.
In the event of inclement weather, emergency, government mandated Covid-19 shutdown, or any other situation beyond the Client’s control, Fancyful will give the Client the opportunity to reschedule or cancel the event. If Client is unable to reschedule or if Client or Fancyful chooses to cancel due to unforeseen circumstances, Client will be entitled to a full refund. If the event is cancelled within 48 hours, for reasons not stated above, no refund will be given. In the event that a partial refund is due, Client will note that any credit card processing fees will not be refunded.
Client understands that Fancyful personnel do not carry cash on hand with which to make change. Tips are not required but encouraged, and will be solely for the performer(s) to whom they are given. Any cash payment in excess of the balance due will be considered a tip and divided evenly among the performer(s).
If anyone in Client’s household experiences a fever, or cold/flu-like symptoms leading up to the Client’s party, Client will notify Fancyful management immediately so that a plan can be discussed.
Client will receive any additional need-to-know information pertinent to his/her party via email from Fancyful Management.
